Right to Suspension

 

You have the right to ask to temporarily suspend the processing of your personal data for specified purposes. This means that you can limit the way that the Controlling Service uses your data for a limited period of time.

The right can be executed in specific circumstances, as detailed below:

  1. Temporary suspension of processing until such time as correction or deletion can be effectively done

    This means that a request for correction or deletion should be submitted first. You should then explain which processing shall be suspended (example: put immediately on hold the overtime retribution calculation until the request to correct overtime data has been treated).

  2. Refrain from deletion of the personal data because the data is required for the establishment, exercise or defence of legal claims

    In this case, the Controlling Service does not need the data any longer and would therefore delete it, but you require the data to establish, exercise or defend a legal claim. You should provide a detailed and reasoned justification to allow the Controlling Service to take an informed decision.

    In case your request receives a positive response, it is important to inform the Controlling Service once the data is no longer required for the legal claim, so that the data can be deleted.
